Hosting Agreement
This Agreement is entered into by and between Regery Services and you, and is made effective as of the date of electronic acceptance. This Agreement sets forth the terms and conditions of your use of Regery's services (or the "Services"). The terms "we", "us" or "our" shall refer to Regery. The terms "you", "your", "User" or "customer" shall refer to any individual or entity who accepts this Agreement. Unless otherwise specified, nothing in this Agreement shall be deemed to confer any third-party rights or benefits.
Your electronic acceptance of this Agreement signifies that you have read, understand, acknowledge and agree to be bound by this Agreement, which incorporates by reference each of:- Regery Terms of Service Agreement
- This agreement and the referenced agreements.

Privacy
Personal Information & Service Usage
Regery's Privacy Policy governs all Services and outlines your rights and our obligations regarding your personal information.
Hosting Services & Data CollectionCertain third-party services integrated with our products may process additional personal data during normal operations. Regery collects minimal supplemental information, primarily:
- Service usage logs documenting your actions
- IP address information
All collected data will be processed strictly for its intended purposes.
Third-Party Data You ProvideYou warrant that for any third-party personal data you supply through our Services, you have:
- Disclosed the collection purposes
- Identified data recipients
- Specified mandatory vs. voluntary data fields
- Provided access/rectification methods
This obligation extends to future data submissions. Regery bears no liability for your failure to obtain proper consent or provide accurate information.
Visitor Data ProcessingWhen using our Services, you may collect website visitor information. Important notes:
- Regery does not directly collect visitor data - we only process information you've collected as part of hosted content
- Integrated third-party tools may collect data to enhance service functionality
- Modification of Agreement
Regery reserves the right to modify this Agreement and its Services at any time in its sole discretion. All such modifications shall become effective immediately upon implementation and shall apply to your continued use of the Services.
By maintaining your use of the Services following any modifications, you expressly acknowledge and agree to be bound by the amended terms. The original terms shall remain in full force for the duration of your active subscription or use of Regery's Services.
Your continued utilization of the Services after any modifications to this Agreement or changes to the Services constitutes your acceptance of such changes and your agreement to comply with all revised terms.

Content Responsibility & Data Management
User Obligations
You assume all risk for loss or damage to your hosted content and server data. You are exclusively responsible for:
- Maintaining account credentials confidentiality
- All activities conducted through your account
- Any charges incurred under your account
You must implement measures to:
- Safeguard server content against loss or damage
- Maintain independent backup copies of all content
- Ensure data security, confidentiality, and integrity on our servers
- Protect account password confidentiality
Service Limitations
Important Restrictions:- Services must not be used for data backup/archiving
- Online storage of archive files is prohibited and may result in immediate service termination
- We reserve right to delete archives affecting server performance without liability
- Our environment is not PCI compliant by default
Regery disclaims all liability for prohibited use of services.

Backup Policy
While Regery may maintain operational backups for business continuity:
- These are for internal recovery purposes only
- Backups are automatically purged upon subscription expiration
- You retain sole responsibility for maintaining your own backups
- No rights are granted to Regery-created backups

Third-Party Content
When using our hosting services to host third-party content, you acknowledge and agree that:
- You maintain ultimate responsibility for all content on your hosted site
- All content must comply with our Acceptable Use Policy
- You must implement a reporting mechanism for policy violations including:
- Trademark or copyright infringement
- Privacy violations
- You are required to actively monitor and promptly address all reported violations
Regery reserves the unilateral right to terminate services if you fail to adequately respond to complaints.
- Advertising and Web Space
If you choose to sell advertising or web space to third parties:
- You assume full responsibility for all advertising content
- You are accountable for the actions of these third parties
- Regery maintains absolute discretion to reject any content that:
- Violates applicable laws
- Contains offensive material
- Breaches current Regery policies
Violations may result in immediate account suspension or termination without notice.

Termination and Cancellation Policy
The initial term of your agreement with Regery will be specified in your Order Form, commencing upon service activation. Following this Initial Term, your agreement will automatically renew for equivalent successive terms unless terminated according to these provisions.
Termination may occur under the following conditions:
- By you, through disabling auto-renewal at least eight (5) business days prior to renewal
- By Regery immediately and without notice if you violate any agreement terms
- By Regery if your service usage creates unreasonable operational demands
- By Regery if you violate terms of any other agreement with Regery
Upon termination:
- No pre-paid fees will be refunded
- For terminations Regery may assume control of any associated domain names registered through our services
If termination results from your default, you agree to:
- Bear all termination costs
- Reimburse Regery for reasonable account closure expenses
- Cover all enforcement costs related to this section

Customer Support Terms
Regery provides customer support as described in our Terms of Service. Additional support for hosting services is subject to the following conditions:
Your Responsibilities:
- You maintain sole responsibility for all content management including:
- Website files and databases
- Email accounts and configurations
- Backup copies of all data
- You must complete and verify backups before requesting support
- You assume all risk for support outcomes and are responsible for restoring from backups if needed
- You acknowledge support processes may involve errors or unintended consequences
Credential Security:
- When providing access credentials for support:
- Use temporary credentials when possible
- Change all credentials after support completion
- You bear responsibility for any issues arising from failure to secure credentials
Support Restrictions:
- Regery reserves the right to refuse support for:
- Systems using unauthorized third-party tools
- Modified or unsupported configurations
- Support denials are at Regery's sole discretion
- You maintain sole responsibility for all content management including:

Content Transfer Obligations
You acknowledge and agree that at all times during this Agreement, you maintain sole responsibility for:
- Preserving backup copies of all your content
- Managing the transfer of your content in case of termination
Upon termination of this Agreement (whether initiated by you or Regery for any reason):
- You bear exclusive responsibility for migrating your server content from Regery's servers to another provider
- Regery is under no obligation to:
- Create backup copies of your content
- Facilitate content transfers via FTP or other methods
- Provide migration assistance for your server content
Important Notice:Regery strongly recommends maintaining current backups of all content as protection against potential data loss during termination transitions.

Use of Services
All hosting services and related electronic services provided by Regery must be used in compliance with:
- All applicable international laws and regulations
- Federal, provincial, and municipal statutes
- Regery's Acceptable Use Policy
Our services are designed for website hosting purposes only, not for off-site electronic file storage.
Consequences of Violations:
- Any breach of the Acceptable Use Policy or this Agreement may result in:
- Immediate service termination without notice
- Termination after a cure period (at Regery's sole discretion)
- Regery reserves the right to deny service for content that is:
- Illegal or promotes illegal activities
- Misleading or fraudulent
- Obscene or offensive
- Otherwise in violation of our Acceptable Use Policy
Liability Limitations:
You acknowledge and agree that Regery shall bear no liability for:
- Any service refusal or termination under this section
- Resulting damages or losses from such actions
- Business interruptions caused by enforcement of these terms
All determinations regarding violations shall be made at Regery's sole discretion.

Intellectual Property Protection
As a service provider, Regery respects intellectual property rights and complies with applicable copyright laws.
Account Termination Rights:
- Regery expressly reserves the right to:
- Terminate accounts after repeated copyright violations
- Immediately terminate accounts for a single severe infringement
- Suspend access privileges of any subscriber violating intellectual property rights
- All termination determinations will be made:
- At Regery's sole discretion
- Based on the circumstances of each case
Important:Subscribers are responsible for ensuring all hosted content complies with intellectual property laws. Regery's termination rights under this section apply equally to trademark and other intellectual property violations.
