Hosting Use Policy

This Hosting Use Policy is entered into by and between Regery Services and you, and is made effective as of the date of electronic acceptance. This Agreement sets forth the terms and conditions of your use of Regery's services (or the "Services"). The terms "we", "us" or "our" shall refer to Regery. The terms "you", "your", "User" or "customer" shall refer to any individual or entity who accepts this Agreement. Unless otherwise specified, nothing in this Agreement shall be deemed to confer any third-party rights or benefits.

Your electronic acceptance of this Agreement signifies that you have read, understand, acknowledge and agree to be bound by this Agreement, which incorporates by reference each of:
  1. Regery Terms of Service Agreement
  2. This policy and the referenced agreements.
  1. Payment Terms
    • Accounts violating the Terms of Service will be terminated immediately, with all payments forfeited.
    • If your account becomes overdue, it will be suspended. Reactivation requires full payment of the outstanding balance. For shared hosting accounts, if payment isn't received within 7 days after the billing date, Regery may terminate your services for non-payment.
    • Regery may temporarily deny service or terminate this Agreement if you fail to pay charges on time. Termination or denial does not remove your responsibility to pay all accrued charges, including reasonable interest and collection fees.
    • If data loss occurs due to Regery's error, we will attempt free data recovery. Shared servers may have backups, but no guarantees (expressed or implied) are made about backup integrity.
  2. Prohibited activities

    By accessing or utilizing any Services provided by Regery ("Company"), You ("User") expressly agree to comply with the following restrictions and acknowledge that any violation may result in immediate account suspension or termination, without prior notice or refund, at the sole discretion of Regery.

    Legal Compliance
    • User shall not violate any applicable federal, state, local, or international laws, regulations, or ordinances, including but not limited to:
      • Data protection and privacy laws (e.g., GDPR, CCPA);
      • Intellectual property laws (e.g., DMCA);
      • Anti-spam legislation (e.g., CAN-SPAM Act);
    Prohibited Content & Conduct
    • Unauthorized Access: User shall not attempt to access, disrupt, or exploit Regery’s systems, servers, or other customer accounts, including but not limited to:
      • Remote execution of malicious code;
      • Denial-of-service (DoS/DDoS) attacks;
      • Port scanning or network intrusion;
    • Fraud & Misrepresentation: User shall not:
      • Forge headers or impersonate any entity;
      • Engage in phishing, identity theft, or fraudulent activities;
      • Distribute prescription drugs in violation of the Ryan Haight Act;
    • Illegal or Harmful Content: User is strictly prohibited from hosting, distributing, or linking to:
      • Content infringing third-party rights (copyrights, trademarks, patents);
      • Adult material, hate speech, or incitement to violence;
      • Malware, proxy scripts, or torrent-related services;
      • Gambling, HYIP schemes, or illegal MLM operations;
    Enforcement & Termination
    • Regery reserves the exclusive right to:
      • Remove any content violating this Agreement without prior notice;
      • Suspend or terminate accounts immediately upon policy violation;
      • Permanently delete all data (including backups) upon termination;
    • User forfeits all fees paid upon termination for violations.
    • Regery disclaims all liability for losses arising from enforcement actions.
    User Warranties
    • User represents and warrants that:
      • All hosted content is lawfully owned or licensed;
      • No content violates third-party rights or applicable laws;
      • Services will not be used for illegal or abusive purposes;
    General Provisions
    • Regery may modify these terms at any time, with continued use constituting acceptance.
    • User agrees to indemnify Regery against all claims arising from prohibited activities.
    • This section survives termination of the Agreement.
  3. Email And Anti-Spam Policy

    You must comply fully with the CAN-SPAM Act of 2003 and all applicable regulations governing commercial electronic messaging. This policy forms an integral part of our Terms of Service.

    Prohibited Email Activities
    • All mass email communications must utilize Confirmed Opt-In or Closed-Loop Opt-In verification
    • You must maintain complete, accurate, and verifiable records of all recipient consents for a minimum of 3 years
    • The following activities are expressly prohibited:
      • Using Regery infrastructure to receive replies from unsolicited emails
      • Email header forgery ("spoofing") or other forms of identity deception
      • Utilizing third-party proxy services or proxy mailing software
      • Operating open mail relays or unauthenticated SMTP servers
      • Hosting content promoted through spam ("spamvertising")
      • Providing any services that facilitate spamming activities
      • Distributing unsolicited messages through alternative channels including:
        • Weblogs/comment systems
        • IRC/chat rooms
        • Guestbooks
        • Usenet posts
        • Instant messaging systems
        • SMS/text messages
    Enforcement And Penalties
    • Regery reserves the right to immediately suspend services upon detection of spam-related activity
    • A minimum administrative penalty of 299 EUR will be assessed for confirmed violations
    • You expressly authorize Regery to:
      • Charge all penalties to your payment method on file
      • Disclose your information to anti-spam organizations and blacklists
      • Share violation details with affected third parties
    • All decisions regarding spam determinations shall be at Regery's sole discretion
    Recordkeeping Requirements
    • You must maintain verifiable proof of consent for all recipients, including:
      • Opt-in timestamps
      • Source IP addresses
      • Collection method documentation
    • Records must be produced within 24 hours of request
    • Failure to produce records constitutes admission of violation

    Regery maintains a zero-tolerance policy towards spam-related activities. We reserve all available legal and technical remedies to prevent abuse of our network, including but not limited to immediate termination of services, imposition of financial penalties, and cooperation with law enforcement agencies.

  4. Transfer Of Content Upon Termination
    • Upon termination of this Agreement or cessation of services, Client bears sole responsibility for:
      • Migrating all server content from Regery infrastructure
      • Coordinating data transfers to new service providers
    • Regery expressly disclaims any obligation to:
      • Provide FTP or other file transfer services
      • Maintain content backups post-termination
      • Assist with service migration to other providers
    • Client data will be permanently deleted following termination procedures

    Regery's Reservation Of Rights
    Regery explicitly reserves the following rights at its sole discretion:
    1. Usage Policy Enforcement:
      • To establish and modify acceptable use thresholds
      • To implement service limitations as necessary
    2. Client Verification:
      • To request and require documentation including:
        • Business registration proofs
        • Government-issued identification
        • Licenses and regulatory approvals
      • To suspend services pending verification
    3. Termination for Cause:
      • For harassment of Regery or third parties
      • For non-payment of due fees
      • For violations of Acceptable Use Policy
      • For activities damaging to Regery's reputation
    4. Legal Risk Mitigation:
      • To terminate services that are or may become:
        • Subject to legal action
        • Involved in threatened litigation
        • Potentially legally actionable
      • Regardless of ultimate legal merit
    5. Discretionary Termination:
      • To cease services at any time with or without cause
      • Without obligation to monitor client activity
    Right Of Refusal
    • Regery maintains absolute discretion to:
      • Refuse service to any entity or individual
      • Reject service applications without justification
      • Cease existing services without prior notice
    • No refunds shall be due for refused or terminated services
